there is a law in the united states that has been on the books for 160 years.
“only the portrait of a deceased individual may appear on united states currency and securities.”
that law exists because of a man named spencer clark. in 1866, clark a living treasury official put his own face on a five cent note. the public outrage was immediate and intense. congress passed legislation banning the practice within months.
on thursday, treasury secretary scott bessent stood at the white house briefing room podium and showed reporters a mockup of a proposed $250 bill.
trump’s face. trump’s signature. a 250th anniversary of america logo.
trump is alive.
What the Trump $250 Bill Actually Is
the trump $250 bill story began publicly on thursday when the washington post reported that trump administration officials had been pressing the bureau of engraving and printing the agency that literally prints america’s money to design a new denomination featuring the president’s portrait.
the washington post reported that it was two trump political appointees who began urging the drafts of the new $250 note be created, including mocking up the president’s likeness.
treasury secretary scott bessent confirmed the mockup exists during thursday’s white house briefing. he said the treasury department does “prepare things in advance” a tacit confirmation of the story.
but bessent was careful to note the legal reality.
“the two mandates for US currency, at present,” bessent said, “are that no living person can be on US currency, and the currency must say ‘in god we trust.'”
he added: “i don’t think that there’s anything untoward about having the president of the united states the person who was president of the united states on the 250th anniversary on the bill.”
The Law That Would Have to Change
US code reads: “only the portrait of a deceased individual may appear on united states currency and securities.” after a then-living treasury official, spencer clark, appeared on a note and caused public uproar, congress prohibited the portrait or likeness of any living person on currency notes, bonds or securities.
for the trump $250 bill to become real, congress would have to change that law.
last year, rep. joe wilson of south carolina introduced the “donald j. trump $250 bill act,” which was referred to the house financial services committee.
wilson’s legislation has shown little movement, and the bureau of engraving and printing says banknote development can take years of testing.
but the fact that the treasury has already produced a mockup and the secretary is displaying it publicly at a white house briefing suggests the administration believes congressional action is coming.
if congress changes the law, trump would be among just a handful of people to ever appear on US currency while still alive. the last was spencer clark in 1866 whose self-portrait on currency caused such outrage that congress banned the practice immediately afterward.
His Signature Is Already on Your Money
the $250 bill is the most dramatic element of this story. but it is not the only one.
earlier this year, the treasury department announced that trump’s signature would appear on all new printed paper currency replacing the traditional signatures of the treasury secretary and treasurer. this is a first for a sitting president.
this has already happened. new bills coming off the presses at the bureau of engraving and printing carry trump’s signature. if you receive a new bill today, his name is on it.
treasurer brandon beach said at the time that the design was in honor of the country’s semiquincentennial america’s 250th anniversary on july 4, 2026.
The Bigger Pattern
the trump $250 bill does not exist in isolation. it is part of what critics are describing as an unprecedented campaign to attach trump’s name and image to american institutions.
over the course of trump’s second term, GOP congressional allies have introduced proposals to make trump’s birthday a federal holiday. others want to carve trump’s face into mount rushmore. some have unveiled legislation to rename dulles international airport after trump. others have backed a bill to name washington DC’s subway system after the president and his MAGA slogan.
there is also a proposed commemorative passport featuring trump’s image and a commemorative coin already in circulation.
the push to break from tradition has prompted criticism that the move appears to elevate trump to the status of a monarch.
others have raised concerns about what message the commemorative currency sends amid a growing affordability crisis that has been exacerbated by economic and energy shocks related to the US and israel’s war against iran.
gas prices are elevated. inflation is a top concern for american households. and the treasury is designing a $250 bill with the president’s face on it.
What Bessent Said About the Optics
when reporters pressed bessent on whether this was appropriate, he was direct.
“i don’t think that there’s anything untoward about having the president of the united states, the person who was president of the united states on the 250th anniversary bill,” bessent said.
democrats have criticized the proposal. senate minority leader chuck schumer and house minority leader hakeem jeffries both issued statements calling the proposal inappropriate and comparing it to the behavior of authoritarian leaders who place their own image on their country’s currency.
the white house did not respond to those comparisons.
The Historical Precedent
the reason the law exists is worth understanding clearly.
spencer clark was the superintendent of the national currency bureau in 1866. during the civil war, the government printed five cent fractional currency notes small bills used because coins were being hoarded. clark approved the design of one such note to include his own portrait.
the backlash was immediate. congress passed legislation specifically prohibiting any living person from appearing on US currency within months of the clark incident.
that law has been in place for 160 years.
it is now being considered for repeal specifically to allow one living person’s face to appear on a new denomination that does not currently exist in the US monetary system.
Trump $250 Bill The Bottom Line
federal law currently says only dead people can appear on US currency. that law was passed because a living official put his own face on money and the public was outraged.
congress is now preparing to change that law so that a living president can appear on a new $250 bill.
trump’s signature is already on every new dollar bill being printed.
his face is on proposed commemorative passports and coins.
his name has been proposed for airports, subway systems, federal holidays, and mount rushmore.
if congress passes the legislation, trump would be the first living person on US currency since 1866.
bessent says there’s nothing untoward about it.
the man whose face caused the 160-year-old law to be written in the first place was named spencer clark. nobody remembers him.
